It's brand new from AtariAge.

Tempest was never released for 5200 back in the day. The project started but was never finished.

Decades later the unfinished game was discovered and finished for sale at AtariAge. I bought it on their eBay store. :)

I don't think there are any used copies for sale, the only way to buy it is new.
